Purpose of the website

https://www.quizboxing.fr is a business-to-business website. It presents the concept, technical specifications and deployment conditions of the Quiz Boxing game, published by Curious Factory, and allows interested professionals to contact the company.

The website is not an online sales platform. No order can be placed directly on it: any commercial relationship is governed by the contractual terms signed between Curious Factory and its professional customer.

Access and availability

Access to the website is free of charge, excluding internet connection costs borne by the user.

Curious Factory endeavours to keep the website accessible 24 hours a day, 7 days a week, but is bound in this respect only by an obligation of means. Access may be interrupted, in particular for maintenance, updates, technical failure or any cause beyond the publisher’s control, without any right to compensation.

Curious Factory reserves the right to modify, suspend or discontinue all or part of the website at any time and without notice.

Software and operation of the game

The Quiz Boxing software, its interfaces, technical architecture, game content and question databases are protected by copyright applicable to software under Articles L. 112-2 13° and L. 122-6 of the French Intellectual Property Code, and by database rights under Articles L. 341-1 et seq. of the same code.

They are made available to operators solely under a named, non-exclusive and non-transferable licence to use, entered into with Curious Factory and limited to the operating site designated in the agreement.

Any use, copying, decompilation, reverse engineering, provision, sub-licensing or commercial exploitation of the software or of the game system outside the scope of a valid licence is unlawful and will be prosecuted, in France and abroad.

Likewise, the use of Quiz Boxing promotional visuals, photographs and videos by an unlicensed third party, in particular to promote a competing or similar activity, constitutes infringement and, where applicable, unfair competition and free-riding.

Data collected, purposes and retention periods

Contact form and information requests: surname, first name, company, job title, email, telephone, country, message. Legal basis: legitimate interest in responding to a business enquiry and pre-contractual measures. Retention: 3 years from the last contact.
Newsletter and marketing communications: email, name, company. Legal basis: legitimate interest in a business context, or consent. Retention: until consent is withdrawn, then 3 years.
Customer relationship management: identification and billing data. Legal basis: performance of the contract and legal obligation. Retention: for the term of the contract, then applicable statutory periods, up to 10 years for accounting records.
Audience measurement and website operation: connection data, IP address, cookies. Legal basis: consent, except for strictly necessary cookies. Retention: 13 months for cookies, 25 months for audience data.

Mandatory form fields are identified as such; if they are not completed, the request cannot be processed.

Recipients

Data is intended for authorised internal departments of Curious Factory and for its technical processors acting on its instructions: hosting, customer relationship management, email sending, process automation, invoicing and payment collection. No data is sold or transferred to third parties for commercial purposes.

Some processors may be established outside the European Union. Such transfers are then governed by appropriate safeguards, namely the European Commission’s standard contractual clauses or an adequacy decision.

Rights of data subjects

In accordance with Articles 15 to 22 of the GDPR, every individual has the right to access, rectify, erase, restrict the processing of, object to and port their data, as well as the right to give instructions concerning the fate of their data after their death.

These rights may be exercised by email to contact@quizboxing.fr or by post to the registered office address, together with any evidence enabling the applicant’s identity to be verified. A response is provided within a maximum of one month.

Security

Curious Factory implements appropriate technical and organisational measures to preserve the security, integrity and confidentiality of the data processed and to prevent it from being distorted, damaged or disclosed to unauthorised third parties.

strictly necessary cookies for the operation of the website (session, security, display preferences, storage of cookie choices), placed without prior consent in accordance with Article 82 of the French Data Protection Act;

In accordance with Article 6-I-5 of the LCEN, any user who identifies manifestly illegal content on the website may report it to contact@quizboxing.fr, stating the date of the observation, the identity of the notifying party, a description and the precise location of the disputed content, and the reasons why it should be removed.

Governing law and jurisdiction

These legal notices and the use of the website are governed by French law, regardless of the user’s place of connection.

In the event of a dispute and failing an amicable settlement, exclusive jurisdiction is granted to the courts of Cannes, France, notwithstanding multiple defendants or third-party proceedings, including for urgent or protective proceedings.
